Term Of Agreement
- Prestige offers a 3 months guarantee from the date the candidate starts its employment with the client.
- Prestige is entitled to exclusive rights to source candidates for a period of 30 days from the date of confirmation of an assignment. "Exclusive rights" means that the client shall not appoint and assign any other third party (including but not limited to any individual, legal person, organization, corporation or unit) except Prestige during the settled period to do the referral and executive search.If the client disagree with the exclusive rights during the settled exclusive period, should any candidate be appointed to the position, irrespective of the source, the Prestige service fee specified in Article 1 is still apply. Exclusive right can be released after a period of 30 days when a review of assignment progress is completed.
- The introduction effected by Prestige to the client is confidential and is not for referral to any third party, organization or person associated with it. Should the client directly hire, or introduce a candidate to any of the above mentioned resulting in the employment of the candidate on a permanent or temporary basis within a period of 12 months after the initial referral, the client to whom the candidate was referred by Prestige shall, without limitation pay Prestige the relevant service fee as stated in Article 1.
- Whilst Prestige endeavors to select candidates who are suitable for the client's needs, it is recognized that the client has full responsibility for the final selection, recruitment and on-going supervision of any member of staff. Prestige, therefore, cannot accept or be held liable on behalf of Prestige, Prestige servants or agents for any loss or damages, or other costs, irrespective of how they are caused, which the client may suffer or for which the client may become liable, arising out of, or in connection with, the introduction of the candidate to the client.
